In recent years Cameron County and other cities in Texas have seen a growth of eight-liner gaming devices.  These devises look like and are very similar to video poker and slot machines. Operators have tried to circumvent the state gambling laws by claiming exemption under the so called "fuzzy animal" exception or claiming that the games are for amusement only.  
An opinion was sought from the Galveston County District Attorney's office on exactly what constitutes illegal gambling in relationship to eight-liners.  They have advised that any of the following actions believed to be violations of the law that could result in prosecution:
Any award of cash, gift certificates, or anything, which may be exchanged for cash or gift certificates, including, certificates or tokens used for replay on a gambling device, regardless of value.
 Any transfer of credits earned on one machine to another machine or the replay of credits earned on a machine in that or any other machine at a later date.
Any award of non-cash merchandise prizes, toys, or novelties that have a wholesale value available from a single play of the game or device of more than 10 times the amount charged to play the game or device once, or $5.00, whichever is less. The accumulation or stacking of credits/tickets toward the purchase of more valuable prizes will be considered to be a violation of the law if the accumulated credits exceed the maximum value for a prize which can be awarded from the machine as noted above.  The wholesale value of the prize, not the ticket, available from a single play, must be no more than 10 times the amount charged to play or $5.00, whichever is less.
Additionally, the practice of “match play,” where the owner or operator of a game or device “matches” the consideration paid by a player to play a game may subject the owner or operator to criminal prosecution if (1) the owner or operator puts cash into the machine, thereby rewarding the player with cash for play on the machine (see number 1, above); or (2) the owner’s match has the effect of reducing the cost to play the game.
The use of “door prizes” to attract customers is presumed to be legal, provided the players are not given additional entries into the door prize drawing based on the number of credits they win on a game or device.
Regarding the “charitable sweepstakes” issue: Typically this is done by some type of an association being made with the charity group by the owner of the 8-liners.  The players put their money into the machine as a “donation” and you are allowed to play the game for free.  At the end of the day the Charity may pay the owner of the machines $.90 out of every $1.00 collected.  This is not an exception to the law.
Operators of the game rooms that have these devices are subject to prosecution for (1) Gambling Promotion, (2) Keeping a Gambling Place, and (3) Possession of Gambling Device, Equipment, or Paraphernalia.   These are all Class A misdemeanor offenses that are punishable by up to a year in the county jail and or a possible fine up to $4,000.00. 
If found to be in violation of the statutes, the response may include the execution of warrants on your business and the seizure of illegal devices and monies not only from the devices, but also from your business and where appropriate your financial accounts.  If three or more persons combine to carry on said offense(s), the punishment can be increased to a State Jail Felony, punishable by anywhere from 180 days up to two years imprisonment in a State Jail Facility and a possible fine not to exceed $10,000.00.

After downloading Barack Obama's newly released long form birth certificate, and loading it in Adobe Acrobat to take a look, I noticed that the background and some miscellaneous text on the document loaded separately than the background image it is purportedly printed on. It seems the background image is a separate scan of safety paper, what birth certificates and checks are printed on. But after uploading into Adobe Illustrator, I found that is it a "built" or carefully constructed document containing many layers that the creator apparently forgot to "flatten". The proof is in this video. I don't claim to know WHY this was fabricated... furthermore, after reading new "birth certificate" it seems odd that the President wouldn't have released this 2 years ago when asked as there is no information on it that he would have wanted or needed to keep from the public.

DONALD TRUMP TAKES "NO NEW TAXES" PLEDGE


Potential 2012 Republican presidential candidate Donald Trump essentially forced President Obama to release his long form birth certificate yesterday.  With that issue resolved, Trump is likely to focus his sights on policy, such as on China and taxes.
Tuesday, Trump signed Grover Norquist’s Americans For Tax Reform’s “no new taxes” pledge, but not before adding a twist befitting Trump.  According to a copy of the pledge he signed, it reads: “I, Donald J. Trump, pledge to the taxpayers of the United States of America that I will oppose and veto any and all efforts to increase taxes.”  Then, in what is becoming a patented use of a Sharpie pen, Trump wrote in “Except on China and other countries that have consistently taken advantage of our great country.”
Trump subsequently wrote to Norquist and said that “as you know, I’m seriously considering becoming a candidate for the President of the United States, and, based upon that, I have agreed to sign the pledge, except, as I have stated on the pledge, will not agree not to raise taxes on China and other countries that have consistently taken advantage of our great country."

EDC ENGINEERS MAKE MAJOR MISCALCULATION IN BASS PRO SHOP PARKING LOT DIMENSIONS: ADDITIONAL COST AT LEAST $870,000 DOLLARS MORE THAN BUDGETED!

The final figures may be much more but for now the minimum extra costs added onto the already bloated outrageous cost of the Bass Pro Shop project was just dealt a major blow to its budget tonight at the latest meeting of the Harlingen EDC Board meeting held at city hall tonight at 5:30PM.  
It was revealed by the EDC hired engineering firm of Brown, Leal and Associates, that one of their engineers had made a major mistake in calculating the actual square footage of the Bass Pro Shops parking lot area.  Evidently, the engineer made his square footage financial cost projections based on the wrong dimensions of the parking lots.
The mistake will cost EDC an extra $870,000 dollars minimum to correct the major error.  "This is $870,000 that we don't have and we didn't factor into the project, this is a major screw up and puts the EDC deeper in the hole than we ever expected," stated Mr. X, who spoke only on the condition of anonymity.  "The $870,000 is only the minimum extra cost the EDC will have to try and make up somewhere else, this figure could go much higher than that when you add in the cost of extra materials, the higher price of petroleum based products like asphalt, extra sales taxes on the materials needed, extra bonding costs, additional equipment, and of course the cost of extra labor to do the added parking lot square footage that was not figured into the original cost figures," said Mr. X.
 
"The final figure to make up this horrific mistake could be anywhere between $870,000 and $1,000,000 dollars extra by the time everything is factored in," he said with a disgusted look on his face.  
Among other options, the EDC discussed taking out a loan for $3 million dollars at 6% interest over a 5 year period to help alleviate their financial crisis.
On a brighter note, the EDC employed engineering firm of Brown, Leal and Associates spokesman, Jack Brown, related that he was able to negotiate a savings of $300,000 dollars on the BPS project thru some serious arm twisting with electrical conglomerate AEP.  Makes you wonder how much fat these guys really have built into these contracts.  $300,000 here and $870,000 there, pretty soon you are talking about some real money!
So, after the dust settled, EDC was only out an extra $570,000 dollars, not a bad days work, all things considered!
